prototype, merenaries 2, infamous, this is vegas, saints row 2, mafia 2. Theres probably a lot more i missed but which one will overall be the best? (exluding GTA IV)

Missing the greatest one of all man: Brutal F*cking Legend!! (middle word added for awesome). That game is going to melt the face off of every other open world game aside from Prototype and maybe Mercenaries 2. Also Just Cause 2 should be on the list as well.

Prototype and Infamous look pretty interesting; Mafia 2, Saints Row 2 and This is Vegas are trying to be GTA wannabs. Mercs 2 looks pretty cool, but Prototype and Infamous are new fresh IP's compared to Mercs (being a sequel and all) so I'm more interested on those two more.

Spore is more of a open universe type game.

Prototype because the developers have experience in making these types of games.
