Actually yes it can be. Just download public servers that players host themselves. Granted, the server population is considerably less.... but, it is in fact free 2 play. Much like what UO did.

The video is listing games that are designed to be free. WoW private servers are illegal, I mean, you don't even have to buy a copy of WoW to play on one, it's just like pirating any other game.
Surely with that same logic, every game you can pirate could be classifies as "free", no?
Hey, free is free. As for not needing the actual game to play on free servers, didn't know that. Granted, I haven't played in over 5 years.... but last time I played you still needed the disk to play, you just didn't have to pay the monthly fee. There is nothing illegal about that because you payed for the game... and you don't have to pay the monthly fee to play on the official servers because you aren't. That is completely legal. If you pirate the actual game though, you're on your own.
You never needed any CD in your drive to play, all you have to do is install the game, heck, you can even download the installation files right from their site. The reason retailers sell the boxed game is because of the CD keys located inside. And you don't need a CD key for a private server, now do you?
If you read their terms of use, it clearly states that you do not own their game, you are merely paying to use their service, so it's kind of like renting.

So if they decide to stop your account, you can't do anything because you never owned it.
But the whole point is, Blizzard owns the software, and you're not allowed to modify their service.
"Additional License Limitations.
The license granted to you in Section 1 is subject to the limitations set forth in Sections 1 and 2 (collectively, the "License Limitations"). Any use of the Service or the Game Client in violation of the License Limitations will be regarded as an infringement of Blizzard’s copyrights in and to the Game. You agree that you will not, under any circumstances:
D. modify or cause to be modified any files that are a part of the Game Client or the Service in any way not expressly authorized by Blizzard"
Which private servers are doing by making the service free of charge and modifying the game mechanics (easier leveling and increased drop rates etc...)
